Foozool-it ("Foozool-it") respects the intellectual property rights of others and expects its users to do the same. In accordance with the U.S. Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Foozool-it will respond expeditiously to claims of copyright infringement committed using the Foozool-it service and/or the Foozool-it website (the "Site") if such claims are reported to Foozool-it in accordance with DMCA notification requirements, as outlined below.
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the DMCA Notice of Alleged Infringement ("Notice"), as outlined below, and delivering it to Foozool-it via our Contact page with subject line "Copyright Infringement". Upon receipt of Notice, Foozool-it will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site. The details provided in the Notice must be sufficient for us to be able to conduct a proper investigation and make a reasonable determination. Please note that you may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any content is infringing your copyright. If you are uncertain whether an activity constitutes infringement, we recommended seeking advice of an attorney. If you choose to request removal of content by submitting an infringement Notice, please remember that you are initiating a legal process. Do not make false claims. Misuse of this process may result in legal consequences and the suspension of services to you.
Prior to submitting this Notice, please be sure to first review our Terms of Use page to better understand the advanced web search and content curation products and services that are being used by Foozool-it to display temporarily cached content, embed broadcasts and/or streams hosted on other unrelated third-party websites, etc. Foozool-it does not assume liablity for content that is freely available elsewhere around the web and where our automated robots are unable to determine if such content is violation of the "fair use" provision of the DMCA Copyright Law and/or if such content fails to comply with copyright and/or licensing requirements.
In the case of third-party hosting of content not managed by Foozool-it, which represents a significant portion of the content shown within the frames of our Site, the proper course of action may be to file this Notice directly with the party that is in fact hosting the content in question instead of submitting this Notice to Foozool-it. Foozool-it has no authority or ability to remove any challenged content from third-pary hosting sites.
Regarding temporary caching of any content by Foozool-it, which may be legally done in accordance with the "fair use" provision of the DMCA Copyright Law in order to provide a functional Site that performs in accordance with user requirements and expectations, our search engine and content curation technology respect the noindex, nofollow, noimageindex, noarchive, nocache, and nosnippet tags in the meta section of webpages. If you wish for any of your website content to not be pick up and/or cached by our automated search engine and content curation technology, then please simply modify the HTML meta section of your webpages with one or more of these above-mentioned tags in lieu of sending an unnecessary Notice given the follow-up action resides on your end as the content owner and/or website master.
Include both of the following statements in the body of the Notice:
